  • The difference between I-485 and DS-260

    1. Form I-485 (Adjustment of Status)

    Purpose: To apply for a green card from within the United States.

    Who Uses It: Applicants who are already in the U.S. on a valid nonimmigrant visa or other lawful status and are eligible to adjust their status to permanent residency.

    Process:

    1. Filed with U.S. Citizenship and Immigration Services (USCIS).

    2. Applicants stay in the U.S. while their green card application is being processed.

    3. Can concurrently file applications for:

    Form I-765 (Employment Authorization Document – EAD) to work while the green card is pending.

    Form I-131 (Advance Parole) to travel outside the U.S. while the green card is pending.

    4. Includes a biometrics appointment and possibly an interview.

    Processing Time: 6–12 months or more, depending on USCIS workloads and visa availability.

    Fee: $1,225 (includes biometrics fee for applicants aged 14–78).
